Dėl žalos atlyginimo žydams ir kitiems

Karas Ukrainoje aštrina ir senas mūsų žaizdas. Okupantai rusai, kurie 1940 m, užgrobė Lietuvą, dabar bando okupuoti Ukrainą. Nors Lietuvai po daug metų kovos ir pasisekė atgauti laisvę – okupantų padarytos žalos klausimas dar neišspręstas. Šiandieną susiklostė unikali situacija, kai atsiranda galimybė iš rusų atsiimti bent dalinę kompensaciją už jų Lietuvai padarytas skriaudas. Ne taip seniai taikydama sankcijas JAV įšaldė daugiau kaip 300 milijardų JAV dolerių vertės aktyvų priklausančių Rusijai.

Ateina žinios, kad areštuojamos ir Rusijos turtuoliams priklausančios vertybės. Kodėl iš šių turtų neišsireikalauti kompensacijos už Lietuvai padarytą žalą?

Trumpai prisiminkime sovietinių okupantų padarytos Lietuvai žalos problemą. Dar 2000 m. birželio 13 d. Lietuvos Respublikos Seimas priėmė įstatymą „Dėl SSSR okupacijos žalos atlyginimo“. Jame konstatuota, kad Rusijos Federacija pagal tarptautinę teisę yra SSSR teisių ir įsipareigojimų tęsėja, taip pat įstatyme yra apibrėžtas padarytos žalos atlyginimas. 1ame straipsnyje (SSSR okupacijos žalos Lietuvai laikotarpiai) įvardijama Lietuvai padaryta žala, o 2ame straipsnyje nurodoma, kad Lietuva turi spręsti žalos atlyginimą derybų su Rusija forma, pateikdama Rusijai šios žalos  apskaičiavimus. Tais pačiais metais buvo suskaičiuota Lietuvai padaryta žala – ji įvertinta 20 (dvidešimt) milijardų JAV dolerių. Kai kurie mokslininkai, skaičiuodami pagal Jungtinių Tautų metodikas žalą neoficialiai įvertino 800 milijardų dolerių. 2012 m. Lietuvoje taip pat buvo įkurta komisija, turėjusi koordinuoti veiksmų planą žalai apskaičiuoti ir atlyginti. Tačiau veiklos ta komisija taip ir nepradėjo. 2017 m. Lietuvos gyventojų Genocido ir Rezidencijos tyrimo centras nutarė oficialų žalos dydį – 20 milijardų JAV dolerių – dar patikslinti, bet dėl eilės priežasčių to nebuvo padaryta.

Savo ruožtu Rusija į derybas neina ir savo propagandistų lūpomis demagogiškai išvedžioja, kad žalos rusų okupantai Lietuvai nepadarė, o priešingai – atnešė laisvę ir gerovę.

Papildomas teisinis pagrindimas žalai atlyginti yra Europos Žmogaus Teisių Teismo 2019 m. kovo 12 d. sprendimas, kuriuo Sovietų okupantų kova prieš Lietuvos partizanus pripažinta genocidu. Tai istorinis Europos Žmogaus Teisių Teismo sprendimas, kai tarptautinis teismas įvertino Sovietų represijas prieš partizanus – reikšmingą Lietuvių tautos dalį – būtent kaip genocidą. Deja, šiuo metu žalos atlyginimo Lietuvai klausimas yra užstrigęs ir visiškai aišku, kad Putino fašistinė Rusija į derybas dėl žalos atlyginimo Lietuvai tikrai neis. Kodėl nepabandyti išsireikalauti žalos atlyginimo tiesiogiai kreipiantis į JAV institucijas? Suprantama, teisiškai įrodant, kad Rusija yra skolinga Lietuvai mažiausiai 20 (dvidešimt) milijardų JAV dolerių – ką reikia nurašyti iš užšaldytų Rusijos aktyvų – Lietuvos naudai. Telefonu paklaustas apie tokį žalos atlyginimo variantą LGGRTC direktorius A. Bubnys išsakė savo nuomonę, kad tai „įdomi mintis“ ir kad galima pabandyti tą padaryti. O žalos atlyginimo Lietuvai klausimo kėlimas visada yra prasmingas, nes okupantai turi žinoti, kad jų nusikaltimai niekada nebus pamiršti.

Įdomu, o kaip Lietuvos vietoje pasielgtų žydų tauta, istorijos eigoje patyrusi ypatingai dideles skriaudas? Žydai pergyveno siaubingą Holokaustą, bet atsigavo, sukūrė stiprią valstybę. Jie niekada nepamiršo savo skriaudėjų, iki pat šios dienos žydai persekioja Holokausto vykdytojus ir nuolat reikalauja atlyginti už jiems padarytą žalą. Nesvarbu, kad pavieniams dar užsilikusiems Holokausto budeliams jau yra netoli šimto metų – žydai vis tiek stengiasi juos patraukti baudžiamojon atsakomybėn. Ir kartais jiems pasiseka. Žydų nusistatymas Holokausto atžvilgiu yra toks „galime susitaikyti, bet niekada neatleisime, niekada nepamiršime“. Susitaikymas reiškia, kad žydai gali bendrauti su valstybėmis, prisidėjusiomis prie Holokausto (aišku, jei tos valstybės smerkia savo praeitį), gali imti iš tų valstybių kompensacijas už prarastą turtą ir Holokausto metu žydams padarytą žalą. PVZ. Holokaustą pergyvenusių asmenų palikuonys gauna taip vadinamus „vokiškus pinigus“ (keliskart į metus po 160 Eurų) ir dar kitokias išmokas. Bet atleisti žydai negali. Jų požiūriu atleisti gali nužudytos aukos, kurios jau kitame pasaulyje ir Dievas. Šių nuostatų žydai laikosi visur ir visada, kai tik yra bent  mažiausia proga priminti pasauliui apie žydams padarytą žalą. Aišku, kad jie nepraleistų galimybės – pabandyti atsiimti pinigines sumas iš JAV institucijų. Tad kodėl nepabandyti lietuviams?

Visiškai akivaizdu, kad Putino fašistinė Rusija į derybas dėl kompensacijos už padarytą žalą Lietuvai neis. Mūsų politikams rimtai pasistengus ir svarbiausia teisiškai kruopščiai, kvalifikuotai padirbėjus – gali ir pasisekti – juk JAV yra teisingumo pasaulyje garantas. O teisingumas reikalauja, kad tokios valstybės nusikaltėlės (kaip yra įvardijamos SSSR ir šiandieninė Rusija) neišvengiamai atlygintų savo aukoms už jų padarytą žalą.

Caroline Glick is an American-born Israeli columnist, journalist, and author. She has written for Israel Hayom, The Jerusalem Post, and Maariv. “NAKBA DAY” IS THE DAY THAT PALESTINIAN ARABS AND THEIR ALLIES HAVE ASSOCIATED WITH ISRAEL’S INDEPENDENCE DAY. THIS YEAR’S RALLY WIL BE SUNDAY MAY 15, 2022.

The arabs view this day as a tragedy, the meaning of the word is defeat and they don’t accept that they were defeated in an uneven defensive war when Israel was attacked by five armies. Israel exists legally, historically, morally and the arabs who refuse to recognize it, hold rallies calling for Israel’s destruction. They see the establishment of modern Israel as a tragedy, and sadly, they are even trying to equate this to the holocaust. They started the war, they lost, and they play victim now for 74 years while continuing to attack Israel and kill innocent people.

We much challenge this hate-fest to be held at Dundas Square, Toronto on government owned property. It calls for the murder of Israelis and is incitement which could harm Jews locally. Many organizations are expressing horror and disgust. WE MUST SEND LETTERS to our government and call for this to be stopped.

But that rally did send messages of hatred, lies and calls for an Intifada, a violent insurrection. The signage indicated that it was well sponsored by some terrorist entities, and flags of listed terror organizations were seen.

  6. Canada hosted a National Summit on Antisemitism at which the Prime Minister declared his commitment to act on this plague of hatred.

  8. This Jew Hatred is promulgated by Islamists, pro-Palestinian NGOs that are aligned with terrorist groups, funding and moral support from the Iranian regime, the Muslim Brotherhood, fanatic radical Imams, and online sites that spout lies and bigotry.

I am very concerned about the Nakba Day rally to be held on Sunday May 15 at Dundas Square in downtown Toronto, organized to challenge Israel’s right to exist and to deny Jerusalem’s connection to Jewish history.  In previous years such rallies have incited hatred and violence against Jews and Israel, and this year’s event is expected to be even more destructive, pushing the theme of a Global Intifada, the call to kill Jews.

Your government and all Canadian governments have stated policies against inciting hatred and antisemitism, thus this event which spreads lies, hatred, bigotry, and calls to harm Jews everywhere, should not be permitted on public land nor supported by any government institutions, including the police.

As a Torontonian and Canadian citizen, I am counting on you to stop this hate fest before it occurs, to take action that supports IHRA, to protect the Jewish community from such harassment, intimidation, threats and calls for violence. Recent statistics reported by B’nai Brith Canada confirm that Jews are the most targeted community in Canada, and it is true in the US as well which the Anti-Defamation League reported this week. The rise in antisemitism is greater each year; it must be stopped with action not just words. The Mayor spoke at Israel’s Independence Day Celebration and said

We must Stand Up, Speak Up and Show Up! So, we are now counting on you to do all three, Show up for Israel, Stand up for the Jewish community and Speak up against Jew hatred!

Earlier this week, former Prime Minister Benjamin Netanyahu attacked Prime Minister Naftali Bennett in the Knesset plenum over the conduct of his government during the current wave of terrorism.
Netanyahu said, „The government of weakness and fraud fails to provide security and peace. There is no deterrence – there is weakness. There is no strength – there is softness. There is no determination – there is lawlessness. Terrorist organizations must be severely harmed like they were under my leadership.”
While earlier reports indicated the end of Bennett’s leadership could happen sooner than we think, updated reports now tell a different story. The Likud party yesterday pulled its bill to dissolve the Knesset after Ra’am chief Mansour Abbas announced that his party will return to the coalition and fulfill its related obligations. With Ra’am’s four MKs, the coalition is back to a 60-60 seat parity with the Likud-led opposition, foiling the opposition’s bid to pass a preliminary reading on Wednesday of a bill to dissolve the Knesset and force elections. Had the opposition brought the measure and failed, it would have been unable to bring a similar bill to a vote again for six months.
Abbas has been meeting with King Abdullah of Jordan and Recep Tayyip Erdoğan of Turkey. His only interest is the destruction of the Jewish State. Recent polls show that 75% of Israeli Arabs believe that Israel has no right to exist.
With the help of a terrorist party in the government that will give Bennett another chance, Bennett is once again dependent upon Arab support to keep him in place as prime minister. Although he is calling for the formation of a „National Guard”, Bennett is not fighting the string of terror threatening Israel and so the defense of the country is compromised. There is no strength and determination coming from him. Sadly, Bennett’s capability to lead Israel has proven a failure. It’s time for him to do the right thing and step down without delay. If Bennett does not do a complete turnaround, make good on his campaign promises and do what he was voted in to do, a new election will certainly be the path forward. From our viewpoint a collapse of this government at some point is inevitable.
From Joy to Terror. How Long Can Israelis Live This Way?
Three people were killed and four others injured in a terrorist attack in the Israeli city of Elad near Petah Tikva towards the end of Yom Ha’Atzmaut last week.
All three victims were men in their 40s. They are Yonatan Habakkuk, a father of five, Boaz Gol, a father of five, and Oren Ben Yiftach, a father of six from Lod.
Some have described the aftermath of the scene of the terrorist attack as eerily similar to the dark days of Israel’s history.
A deadly terror attack was stopped Sunday night when a terrorist was shot after he attempted to infiltrate the Gush Etzion town of Tekoa. The terrorist was armed with a knife but shot and killed by a member of the community’s local security force.
A gunfight between terrorists and the IDF took the life of an Al Jazeera reporter. Gantz has asserted that the fatal shot was fired by an Arab, but who knows what is being reported in the world press. One thing is certain, the fight was initiated by terrorists.
Would things be different, could they be different if all Jews were armed to defend themselves? We may never know. One thing we do know is certain – Israel’s leadership has weakened terribly and its failures are at the expense of the Israeli people. The shedding of Jewish blood must stop!
Our thoughts and prayers are with the victims and we pray for the recovery of those wounded. May the families and all of Israel know no more sorrow and be returned to normalcy in their daily lives.
